Terms of Service:

As a consignor in the August 12, 2023 Kids Clothing and Equipment Sale, I agree to the following:

1. Will sign up for your ONE shift in MyConsignmentSale and attend the Drop-Off Shift


2. Will read the document titled Clothing Sales Guidelines 2023-08


3. I am a paid member of Dayton Mothers of Twins in good standing (please pay dues before registering - www.daytontwinsclub.org) and therefore am exempt from paying the required registration fee.


4. OR I am not a member, but agree that a $15 registration fee will be paid for advertising, software, and rental costs, etc. before I can enter any items into the software


5. Have read and will abide by the Indemnity Information below


6. All items are in good condition, free of rips, stains and tears and are ready for resale.


7. Consignor will receive 85% of the proceeds from the sale of each item sold.

REMINDER: Everyone must attend the Drop-Off Items and Work Shift below in addition to your registered shift. You can start unloading items onto curb and check-in as soon as 6:00pm and all items must be in the building by 6:30pm so we can begin putting them out. You must stay the whole hour (6:30-7:30pm) to put out your items/help others put out their items.

By signing up to shop or work this sale, I, hereby state and affirm that I want to participate in the Dayton Mothers of Twins Club’s (hereinafter “DMOTC”) “August 2023 Kids Clothing and Equipment Sale” (hereinafter “event”), to be held August 11-12, 2023, as a seller/consignor of children’s clothing, toys, and/or other similar items/products (hereinafter “children’s products”). I fully acknowledge and pledge I have read, and/or was advised by DMOTC to read, the Consumer Product Safety Improvement Act of 2008 and have actively checked for product recalls via the Consumer Product Safety Commission's recall website, www.cpsc.gov. I warrant and pledge to the best of my ability that the items and/or products I have presented for sale in this event have not been recalled by any manufacturer and/or company. It is my understanding and belief that any and all items and products I have presented for sale in this event are safe and free from any known and/or reported defect.

FOR AND IN CONSIDERATION of being permitted to participate in the DMOTC “August 2023 Kids Clothing and Equipment Sale,” and for other good and valuable consideration, the receipt and/or sufficiency of which are hereby acknowledged, I, for myself and heirs, personal representatives, successors and assigns, do hereby release and discharge DMOTC, Ohio Federation Mothers Of Twins Clubs Inc., and any business, church, corporate or individual sponsors or event coordinators and/or committee members involved in the event, including their respective agents, employees, officers, successors and assigns, of and from all claims, demands, damages, actions, causes of actions, or suits at law or in equity of whatsoever kind or nature arising out of any personal injury, death, or damage to property which any individual may sustain and/or suffer in connection with the purchase of children’s products I present for sale and participation in said event.

In addition, for the aforesaid consideration, I for myself and my heirs, personal representatives, successors, and assigns, do hereby agree to indemnify and hold harmless DMOTC, Ohio Federation Mothers Of Twins Clubs, Inc., and any business, church, corporate or individual sponsors or event coordinators and/or committee members involved in the event, including their respective agents, employees, officers, successors and assigns, of and from all claims, demands, damages, actions, causes of actions, or suits at law or in equity of whatsoever kind or nature arising out of any personal injury, death, or damage to property which any individual may sustain and/or suffer in connection with the purchase of children’s products I present for sale and participation in said event.

I certify that I have carefully read this Release and Indemnity Agreement, and that I understand the contents of this document and have had all questions answered I may have had regarding this document.
